However I am currently experiencing the same, my diablo 3 was sent out last week and its not here

I got my guest pass yesterday, downloaded at a nice 11.7mb/sec, installed and started it up, never had one problem. Smooth as silk and no "error37" here.
My first impressions: (I only played for 3 hours so..)
-It's good but not fantastic. The feeling is great as is the pace. Story is OK and not as bad as I thought.
-Graphics could be better, I prefer more realistic graphics than the cartonish look, but it's very well made and I like the destruction and artwork. I forget about the graphics quite fast and that is good!
-Sound is good, effects, music and the overall feeling. But.. the voice actors I heard so far isn't my thing. I think it's supposed to be a little "B-actorish" but I just don't like it. They sound like they read directly from a manuscript sometimes.. It really annoys me.
-The new system with skills as you level up is fresh, I can choose skills almost on the fly and those runes are fun to play around with. I'm quite sick of the same old system where you need to put 5 points in this or that to get to the next row and put 10 more points there etc. A'la WoW, Conan, EQ2 etc. I like this much better. It's new and, yeah, Fresh!

The cutscene after act 3... and then the cutscene where the namesake villain appears... hooooo my god. Seriously cool.
Level 41, almost up to Belial. Good times.

Ok, well, I think I am unbiased here. I have never played any point-and-click, click, click type games and this is my first Diablo game ever.
With that said, I did not like it at first, there is too much clicking and I was used to WoW where right-click auto-attacks. As far as I know, the game has no auto attack and that pisses me off.
I am a level 9 wizard on ACT I, I am not saying that I am a Diablo III veteran, the following are just my first impressions.
Likes:Dislikes:
- Customization - Spell selection, runes, itemization: It all seems intuative yet complex later on (I have looked at the talent trees).
- Spell combos - Freeze in place, then AoE
- Co-Op - I will only play Co-Op, I can't imagine soloing without getting bored
- Cut scenes - Pretty cool, even though I have NFI what is going on.
- Teleportation - You can teleport to the local town at any time, then jump right back in to the action right in the spot that you left (I do not know what the limits of this are, but I did it twice without fail to sell a full inventory)
- Clicking - there has to be a better way… moving and attacking require the same clicking button. Sometimes you want to move AWAY from the action but end up clicking on some ****ing zombie instead. No auto-attack.
- Repetition - I am still on ACT I and already tired of: follow mini-map, find enemies and spam-click
- Looting system - I have not found a good way to prevent myself from picking up crap items since you auto-loot when you walk over them. After a short while, the inventory gets full and it is frustrating as hell!
- Crafting system - I am early on so this may change but crafting currently only produces an item with RANDOM stats on it. I wasted 3 sets of material crafting garbage then re-disenchanting them.
- Graphics - Not great at all. Tolerable though.
- WINDOW Mode - I CAN NOT ****ING play at fullscreen no matter what. The option is disabled. I have eyefinity but have to settle with a window size that I have to drag the edges. It also seems to have a locked aspect ratio too, so I can not use all of my screen area no matter what.
- Story - just too much thrown at you at once (Soria from Moria son of Ukel and brother of Yuri battles the Imprezas in the year of the Turin - What?) :D
Overall, using a linear scale, I say that it is a 7/10 because it is fun and that is the point of video games.

You can help this slightly by using the Force standstill button, or whatever they call it in game. I think default is shift.
As a Demon hunter, I kept doing what you describe and walking into melee range. As soon as I started to use this button (I rebound it to `) battles became less painful.
